Can you get a DUI without drinking alcohol?

It is possible to get a DUI in Georgia, even if you have not been drinking alcohol. It is less common, as the majority of DUI arrests do involve alcohol use. But there are situations in which people find themselves facing charges without drinking at all.

This is often referred to as a DUI–drugs charge, and it may involve the use of illegal drugs. Any substance that impairs a person’s ability to drive safely could lead to an arrest. This includes common substances like marijuana, not just alcohol.

Risks with prescription drugs

One thing that often goes overlooked, however, is that even prescription drugs could lead to these charges. There are certain prescription medications that can impair a person’s ability to drive, even though they have a valid prescription and are otherwise using those substances legally.

The key often lies in the warnings and directions that come along with the prescription medication. Many times, it will state that a person should not “operate heavy machinery” while taking that prescription. Among other things, this often means that they should not drive a vehicle.

Moreover, certain prescription drugs can interact with other substances. They could amplify the effects of even a small amount of alcohol, for instance, meaning someone could be impaired even if they have only had a single drink and are still well below the legal limit.
