Do officers have probable cause to arrest you for DUI?

On Behalf of | May 1, 2020 | DUI |

Georgia law enforcement officers have many tools. These tools help them decide on DUI arrests. Some include field sobriety tests, blood tests and breath tests. But how do suspicious facts and circumstances factor into the equation?

These facts may lead to an officer having a probable cause to arrest you. Today we will take a look at probable causes to arrest. We will examine how officers examine the people they pull over to decide whether to arrest them.

What is a probable cause for arrest?

Fieldsobrietytests.org look at probable causes to arrest specific to DUI crimes. In general, what is a probable cause to arrest? When does an officer has a probable cause for arrest? They do if they know facts or circumstances that point to a suspect’s guilt in a crime. They may have already committed the crime. The officer may catch them in the middle of committing it. They may not have even committed the crime yet, but factors show they are about to.

What do officers look for in potential DUI cases?

When it comes to DUI crimes, what do officers look for when searching for probable causes for arrest? Some potential signs include red eyes, slurred speech or the smell of alcohol. If an officer spots these things, they may test you further. They may give you a field sobriety test, a breath test or a blood test. They have reason to believe you may be committing a DUI related crime based on these factors alone. Thus, they seek to find more evidence.

But these signs are not foolproof pieces of evidence. An officer cannot arrest you for having red eyes alone. This is crucial for drivers to keep in mind if an officer pulls them over.
