Georgia man charged with DUI, vehicular homicide after fatal crash

| Jun 14, 2011 | DUI |

A Georgia man has been charged with DUI and vehicular homicide after a motor vehicle accident Monday night that killed a recent graduate of Georgia Tech. Police say the accident occurred when the 42-year-old driver hit the motorcycle that was being driven by the recent grad. The young man was thrown from his motorcycle and hit by another car.

The driver was accused of driving while under the influence of alcohol. According to My Fox Atlanta, the driver has faced DUI charges before. Recently, he pleaded guilty to a charge of reckless driving following a 2009 DUI arrest in Atlanta. As discussed in a previous post, a DUI charge involving an incident in which someone was seriously injured can be a felony. If a person is killed in an accident caused by a person suspected of drunk driving, that person can be charged with vehicular homicide.

The driver had a court appearance on Wednesday, and he will remain jailed until a hearing before a superior court judge. He is facing charges of following too closely, DUI and vehicular homicide. According to My Fox Atlanta, the driver has a good job as a manager in a global shipping corporation. The accident was a tragedy, but the driver’s right is to be considered innocent until proven guilty.

The man who was killed was described as a promising individual who was curious about the world and eager to learn. He had recently graduated from Georgia Tech’s School of Public Policy with high honors.
