Athens police arrest driver, passenger for alcohol-related crimes

As we have mentioned before on our Athens, Georgia, DUI defense law blog, even hitching a ride home from someone else after a night of drinking is not always enough to avoid running into trouble with the law. This is especially true when one's "sober" driver has allegedly been drinking as well.

On Saturday, two college students were arrested by an Athens-Clarke County police officer after the officer suspected that one of the students was driving under the influence of alcohol and that the student's passenger was also drunk and under the legal age of 21.

The Red and Black reported that both students were arrested on Saturday around 11:30 p.m. after the driver had stopped her vehicle to ask a police officer a question. The University of Georgia student, who is 22, wanted to know if she could get access to a parked car at a local business by driving on a road that had just been closed off for an accident. According to the arrest report, the odor of alcohol was detected on the driver's breath while she was speaking with the officer.

The student agreed to take field sobriety tests after informing the officer that she only had one beer prior to driving. The student allegedly failed the tests and was arrested. An officer then asked the driver's passenger whether he could drive the car home in order to avoid having to pay for a tow. While speaking with the passenger, the officer detected the odor of alcohol again and arrested the passenger for underage possession of alcohol. The passenger allegedly had a fake ID on him and was only 19 years old.

The driver did agree to take a breath test after she was arrested. Police reported that the student's test result was above the legal limit of 0.08.
